These Website Terms of Use (“Terms”) set out the terms on which you may access and use the PetDatabase.com website and any associated web or mobile applications (together, the “Site” ).

Please read these Terms carefully before using the Site. By accessing or using the Site, you agree to be legally bound by these Terms. If you do not agree, you must not use the Site.

2. Purpose of the Site

PetDatabase provides an online platform that enables:

  • registration and management of pet microchip data in accordance with UK law;
  • support for the reunification of lost pets with their keepers;
  • use of Smart Pet Tags linked to pet profiles;
  • rescue and rehoming support services, including adoption management and fundraising tools;
  • access to optional third-party services such as pet insurance quotation journeys; and
  • marketing communications and perks, including those made available through Tailster Perks, a brand operated by JPLC Limited, subject to your consent.

PetDatabase is a DEFRA-approved microchip database and operates in accordance with applicable regulatory requirements.

3. Definitions

In these Terms:

  • “Insurance Quote” means a pet insurance quotation provided by a third-party insurance provider via a clickthrough journey from the Site.
  • “Insurance Provider” means a regulated third-party insurance provider with whom PetDatabase has a referral or commercial arrangement.
  • “Pet Keeper” means the person with whom the animal normally resides.
  • “Smart Pet Tag” means a physical identification product linked to the Site that displays selected information when scanned.
  • “Third-party Services” means services provided by third-parties that are accessible through or integrated with the Site.

4. Access to the Site

4.1 The Site is made available free of charge, although certain optional services or products may be subject to separate charges or terms.

4.2 We do not guarantee that the Site, or any Content on it, will always be available or uninterrupted. We may suspend, withdraw or restrict access to all or part of the Site without notice.

4.3 You are responsible for ensuring that anyone who accesses the Site through your internet connection is aware of these Terms and complies with them.

5. Acceptable use

You must not use the Site:

  • In any unlawful, fraudulent or harmful way.
  • To upload or transmit malicious code.
  • To infringe intellectual property or privacy rights.
  • To interfere with the operation or security of the Site.
  • For competitive purposes.
  • Impersonating another person or entity.
  • Using the Site in a way that is intended to harm other users.
  • Behaving or acting any way that creates a negative experience for an existing Site user, to be determined at the sole discretion of Pet Database.
  • Behaving or acting in any way that is unprofessional to any Pet Database staff member, or that may cause upset or harm, to be determined at the sole discretion of Pet Database.
  • Sending threatening or potentially defamatory private messages to users on the Site.
  • Using a profile with incorrect or erroneous information.
  • To modify, mirror, inject or filter or change any Content on the Site without Pet Database’s written consent.
  • To, through usage of any tools, access, copy, acquire information, or monitor the Site or any portion or Content thereof.
  • To circumvent any measures implemented by us aimed at preventing violations of the Terms by creating a new user.
  • It is your obligation to comply with all applicable local, state, federal, national and international laws.

6. Intellectual property

All intellectual property rights in the Site and Content belong to PetDatabase or its licensors.

You may use the Site for personal, non-commercial purposes only. You must not copy, distribute, modify or exploit any Content without our prior written consent.

7. Data protection and privacy

We process personal data in accordance with UK data protection law. Details of how we use personal data, including marketing consents and Third-party Services, are set out in our Privacy Policy , which forms part of these Terms.

8. Disclaimer

The Site and Content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we exclude all warranties, representations and conditions, whether express or implied.

9. Limitation of liability

Subject to this, PetDatabase shall not be liable for:

  • loss of profits, revenue, business or data;
  • indirect or consequential losses; or
  • any loss arising from use of, or reliance on, the Site or Third-party Services.

10. Indemnity

You agree to indemnify PetDatabase against losses arising from your breach of these Terms or misuse of the Site.

11. Termination

We may suspend or terminate your access to the Site at any time. You may close your account by contacting us. Certain provisions of these Terms will survive termination.

12. Changes to these Terms

We may update these Terms from time to time. Updated Terms will be posted on the Site and will apply from the date of publication. Continued use constitutes acceptance.

13. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction.

14. General

  • If any provision is held invalid, the remainder shall continue in force.
  • We may transfer this agreement to another organisation.
  • You may not transfer your rights without our consent.
  • No third-party has rights under these Terms.
